Probate is the Court process used to distribute the estate of the deceased.
The probate process consists of:
- Filing a petition with the court
- Appointing a personal representative
- Paying off debts
- Filing an inventory of the estate
- Distributing assets
- Closing the probate.
How long the probate process can last is dependent upon the type and size of the estate’s assets, how well the estate planning was performed, and whether the heirs choose to challenge the deceased person’s wishes conveyed and contained in the Will, Trust, or other estate planning documents.
